Our voluntary online questionnaires may collect a participant’s name, username, email address, year of diagnosis, type of health condition, and optional demographic details.
  • Information from your device: Photos or content from your device’s camera, calendar, and fitness app information.
  • Health-related information: Information about your health status, medications, type of care sought, sexual orientation, and details related to scheduling medical appointments.
  • Location information: Your general location inferred from your IP address or precise location of your mobile device (with your consent).
  • Information from lead and order forms: Contact and payment information, along with relevant military status or insurance-related details.

You are not required to provide us with any information about yourself. However, if you do not provide us with certain information, the Services may not function as intended, or you may be unable to access specific features. For example, if you do not provide your name and email address, you cannot create an account.

A cookie is a small text file that web servers place on your device, designed to store basic information and help websites recognize your browser. Cookies serve various purposes, such as navigating the Services, personalizing your experience, analyzing usage, saving preferences, authenticating you, and enabling advertising. We may also use pixels in emails to record actions like whether you opened an email or clicked a link.

Mobile App Advertising

When using our Apps or other mobile applications, you may encounter personalized in-app advertisements. We may engage vendors or other parties to deliver ads within mobile applications or for mobile app analytics. Your device’s operating system provides guidelines on how to disable tailored in-app advertisements. For further information on managing in-app advertisements, please consult these guidelines or your device settings. We have no influence over how your operating system permits you to control personalized in-app ads.

Do Not Track

Do Not Track (DNT) is a privacy preference available in some web browsers, which you can learn more about here. Similar to many other Services, FoodInScope does not currently recognize or respond to browser-initiated DNT signals. It’s important to note that DNT differs from the “preference signal” mentioned in the “Your Rights and Choices” section below, which is a browser-based control that indicates whether you wish to opt out of processing your information for specific purposes, including the “sale” of your information or its disclosure for targeted advertising purposes, as defined under applicable laws.

How We Disclose Your Information

We may disclose the information we collect from and about you in the following ways:

  • Personnel: Our employees, contractors, and other personnel have access to your information as necessary to provide the Services.
  • Affiliates: Information you provide to one of our Websites or Apps may be shared with our other Websites and Apps. We may also disclose your information to our corporate affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control), including FoodInScope UK.
  • Vendors: We may share or grant access to your information to vendors that provide services on our behalf, including website hosting, data storage, analytics, research, marketing and advertising, payment processing, security, data enrichment, content, contests, and similar offerings.
  • Advertising: We may share certain data with advertising platforms, such as Google and social networks like Twitter, Facebook, LinkedIn, and Snapchat to allow us to target existing users and customers with relevant advertising campaigns. For these campaigns, we may provide a unique code (such as a hashed email address) to the respective advertising platform to match it against existing users and identify potentially relevant audiences for targeted advertising. We may utilize services like Google Ads’ Customer Match, LinkedIn Matched Audiences, ID5, LiveRamp, and Facebook Custom Audiences for these purposes. In addition to advertisements for our own goods and services, we may also enable third parties to advertise their goods and services, targeting these advertisements to users who might be most interested. To ensure advertisements are relevant to you, we may use your IP address and details about your operating system and device type. Information about your specific device will be used to display advertisements that function correctly on that device. You can adjust your preferences by visiting our Privacy Settings page or the ‘Your Rights and Choices’ section of this policy.   • Business transfers: In the event of a sale of some or all of our assets, merger, reorganization, dissolution, or similar event, including during negotiations of such an event, your data may be part of the transferred assets.
  • Legal compliance: We may disclose your information if required by law or legal process, or in the good faith belief that disclosure is necessary to (1) comply with a legal obligation, (2) protect and defend the rights, property, or personal safety of ourselves, our personnel, users of the Services, or the public, (3) obtain legal advice, or (4) protect against legal liability. This includes disclosures for fraud prevention.
  • With your consent: If you consent to the disclosure of your information, we may do so in line with your consent. You have the right to revoke consent at any time by emailing legal@foodinscope.com with the subject line “Revoke Consent” and detailing the information and disclosure(s) for which you wish to revoke consent.

You may choose to post or otherwise provide information to the Services in a manner that allows other parties to view or access it. For instance, if you interact with the Services via social media platforms or utilize “social features” on the Services (e.g., Facebook plugins), those social media platforms may have access to information about you. If you participate in community forums, others may see information you submit or post on those forums. Your decision to disclose information in these ways is not a disclosure of your information by us.

Your Rights and Choices

Rights Regarding Your Information

Depending on your jurisdiction, you may have the right to make specific requests regarding your “personal information” or “personal data,” as defined in applicable law. This includes, but is not limited to, the right to request that we:

Provide you access to and/or a copy of certain personal information we hold about you. Inform you about the categories of personal information we collect or disclose about you, the categories of sources of this personal information, the business or commercial purpose for collecting this personal information, and the categories of parties to which we disclose this personal information. Correct inaccurate personal information we hold about you. Delete certain personal information we hold about you. Your rights may vary based on your jurisdiction of residence. For example, you may have the right to object to, restrict, or opt out of our processing of certain information. Please refer to the Supplemental Privacy Notice, below, for more information about region-specific rights.

You may exercise the rights provided by applicable law by completing this form. You may also access, correct, and delete specific information through your account with the Services. Certain information may be exempt from your requests under applicable law. For instance, we must retain specific information to provide the Services to you, and we would be unable to continue delivering the Services you requested if we deleted that information. We may also need to retain specific information to comply with applicable law or exercise our legal rights.

We may need to take reasonable steps to verify your identity before responding to certain requests, which may include verifying your name and email address. If allowed by applicable law, you may designate an authorized agent to make requests on your behalf. To do so, you or the agent must provide us with written authorization or power of attorney, signed by you, for the agent to act on your behalf. You still need to verify your identity directly with us.

If we ask for and rely on consent to process information, you have the right to revoke this consent at any time by emailing legal@foodinscope.com with the subject line “Revoke Consent” and detailing the information for which you wish to revoke consent. Please note that revocation of consent will not affect the validity of consent prior to revocation.

Depending on your jurisdiction, you may also have the right to contact the relevant data protection authority with complaints regarding our practices. Please consult the website of your jurisdiction’s data protection authority for more information. However, we encourage you to contact us first to resolve any questions or complaints.

Right to Opt Out of “Sales” and “Sharing”

If you are a resident of California or certain other jurisdictions, you may have the right to opt out of our “sale” or “sharing” of your information, which some laws characterize as “targeted advertising.” As mentioned in the “How We Disclose Your Information” section above, we may provide your information to parties such as advertising providers and partners to deliver more relevant ads and offers that may interest you. Under certain laws, these disclosures may be considered a “sale,” “sharing,” or “targeted advertising.”

As discussed in the “Cookies, Analytics, and Advertising” section above, we may provide your information to advertising providers for targeted advertising, to show you more relevant and tailored ads, and to analytics providers that assist us in analyzing your use of the Services, our user base, and related matters. Under applicable law, the disclosure of your personal information to these parties for these services may be considered a “sale” of personal information, a “sharing” of personal information, or processing of personal information for targeted advertising purposes.

Please note that we do not knowingly “sell” or “share” personal information of individuals under 16 years of age.

Your Choices About Marketing Communications and Push Notifications

  • Email: Subject to applicable legal requirements, if you provide us with your email address, we may send you marketing and promotional communications on behalf of ourselves and other parties (including offers from our partners). You may opt out of these emails using the “Unsubscribe” instructions in the emails. It may take some time to process your request in line with applicable law. If you unsubscribe from marketing and promotional emails, you may still receive administrative and service-related emails from us, such as emails regarding your account and updates to our terms or policies.
  • Text/SMS: Subject to applicable legal requirements, if you provide us with your mobile phone number, we may send you text/SMS-based marketing and promotional communications. To opt out of these communications, reply “STOP” or “UNSUBSCRIBE.”
  • Direct Mail: Subject to applicable legal requirements, if you provide us with your physical address, we may send you marketing and promotional communications via direct mail. To opt out of these communications, please email us at the address below, and include your name and address.
  • Push Notifications: If you opt in to receive push notifications from our Apps, you may also manage your preferences through your device’s settings. You can adjust your preferences to enable or disable push notifications for our Apps at any time.

Cookies, Analytics, and Advertising

To provide a better experience with our Services, we may use cookies and similar technologies. Cookies are small text files placed on your device that help us remember your preferences, enhance your experience, and understand how you use our Services. As with requests to exercise other rights, please note that certain personal data may be exempt from these requests. We may need to take reasonable steps to verify your identity before responding to specific requests, as described in the “Your Rights and Choices” section of this Policy.

If you believe that our processing of your personal data violates EEA or UK privacy laws, you also have the right to file a complaint with a supervisory authority, particularly in the country of your habitual residence, workplace, or where the alleged infringement occurred. c. Children’s Privacy: The Services are not intended for use by children. We do not knowingly collect “personal information” (as defined in the U.S. Children’s Online Privacy Protection Act) from children under 13.
